When can a person use deadly force in Arizona?

13-405. Justification; use of deadly physical force

A. A person is justified in threatening or using deadly physical force against another:

1. If such person would be justified in threatening or using physical force against the other under section 13-404, and

2. When and to the degree a reasonable person would believe that deadly physical force is immediately necessary to protect himself against the other’s use or attempted use of unlawful deadly physical force.

B. A person has no duty to retreat before threatening or using deadly physical force pursuant to this section if the person is in a place where the person may legally be and is not engaged in an unlawful act.

There appears to have been an incident in or around the Zanjero Community in Surprise, Arizona on or about March 29, 2021. The following person (Unidentified appends to attempt intimidation and possible assault to a homeowner / resident.

The unidentified person is the above image appears to get agitated when a resident homeowner comes outside of his hope to look around deciding if the trash cans needed to be moved from what appeared to be a a parked utility truck. While pondering on the issued of moving the trash cans (to allow more room for a sanitation truck to retrieve the trash cans easily) The unidentified person ask the Homeowner what are you looking at, why are you starring to the amazment ans snhock of the homeowner who clearing has the right to look around his or her property.

From that point onward, the situation escalated to the point that the unidentified person started using profanity of foul language towards the home owner which could have very easily escalated into a deadly force issue once the unidentified person would have started towards the homeowner in what could have been conceived as a threat of injury or life as outlined in Arizona Law:

Fortunatly the Homeowner requested police assisatnce; hiowevery the unidentified person togeter with two other people proceeded to leave the area before the police arrived.
